STL Press Release - Public service announcement by the Special Tribunal for Lebanon

Leidschendam, 08 October 2019 – In compliance with the President’s Order pursuant to Rule 76 (E) to effect service in the Prosecutor v Salim Jamil Ayyash case by procedures of public advertisement, and following the efforts undertaken by the Lebanese authorities to effect service, the Special Tribunal for Lebanon (STL) is releasing an audio- visual and audio public service announcement as well as a poster with the biographical information of Mr Salim Jamil Ayyash, accused in the Connected Case STL-18-10. This is part of the STL public advertisement campaign to inform the accused of the need to appear before the Tribunal and to invite the public to submit any information on the whereabouts of the accused to the STL. The poster and messages list the charges against Mr Ayyash and phone numbers at which the public can contact the STL in case they have any information about his whereabouts.  
The Connected Case STL-18-10 relates to the attacks against Mr Marwan Hamade, Mr Georges Hawi and Mr Elias El- Murr on 1 October 2004, 21 June 2005 and 12 July 2005 respectively. The Prosecutor alleges that Mr Ayyash participated in the conspiracy aimed at committing a terrorists act; in the alternative to conspiracy of committing a terrorist acts, criminal association; committing a terrorist act; intentional homicide with premeditation of Messrs Ghazi Abou-Karroum, Georges Hawi and Khaled Moura; and attempted intentional homicide with premeditation of Messrs Marwan Hamade and El-Murr as well as 17 other persons. The public advertisement campaign follows the STL President’s finding that reasonable attempts have been made by the Lebanese authorities to effect personal service on the accused in this case, and those efforts have been unsuccessful to date.
If within 30 days from the advertisement of the indictment on 07 October 2019, the accused is not under the Tribunal’s authority, the Pre-Trial Judge shall ask the Trial Chamber to initiate proceedings in absentia.

On 16 September 2019, The STL Pre-Trial Judge Daniel Fransen lifted the lifted the confidentiality of his decision confirming an indictment against Mr. Salim Jamil Ayyash. The indictment, dated 14 June 2019, alleges Mr. Ayyash is involved in the 1 October 2004 attack against Marwan Hamade, the 21 June 2005 attack against Georges Hawi and the 12 July 2005 attack against Elias El-Murr. These attacks were found to be “connected” to the 14 February 2005 attack. These attacks constitute a new case, STL-18-10.  Judge Fransen also made public the arrest warrants issued against Mr Salim Jamil Ayyash.
On 17 September 2019, the STL President Judge Ivana Hrdličková issued a statement calling the accused to surrender and to participate in the proceedings, informing him of his rights before the Tribunal and notifying the public of the new indictment.
On 24 September 2019, the President further ordered that the service of the indictment against Mr. Salim Jamil Ayyash be effected in an alternative manner, including through public advertisement.
On 25 September 2019, Representatives of the Special Tribunal for Lebanon delivered a poster of Mr. Salim Jamil Ayyash to the Lebanese authorities for the purpose of public advertisement.
